This policy explains how Vergara Digital collects, uses, stores and protects personal information in accordance with South Africa’s Protection of Personal Information Act, 2013 (POPIA).

We may collect information that you provide when you contact us, request a quotation or become a client. This can include your name, business name, email address, telephone or WhatsApp number, project requirements, billing information and communications with us.
When providing domain registration, hosting, website or Google Business Profile services, we may also process information reasonably required to create, configure or manage those services.
2. How we collect information
Information may be collected through our website enquiry form, email, WhatsApp, telephone conversations, client onboarding documents, invoices and direct communications with you.
3. Why we use it
We use personal information only where reasonably necessary to:
- Respond to enquiries and prepare quotations;
- Enter into and perform client agreements;
- Design, host, maintain or support websites and related services;
- Register and manage domains on a client’s instructions;
- Optimise and manage online business profiles;
- Process payments, invoices and business records;
- Protect our systems, clients and legal rights; and
- Meet legal, regulatory, accounting and tax obligations.
4. Marketing
Submitting an enquiry does not automatically subscribe you to marketing. We will use your enquiry details to respond to you. We will only send direct electronic marketing where permitted by law, and marketing communications will include a way to opt out.
5. Service providers
We may use trusted providers to operate our business, including website hosting, form processing, email, communications, cloud storage, payment, domain-registration and analytics providers. They may process information only as needed to provide their services or meet legal obligations.
Our website enquiry form is processed through Formspree. WhatsApp communications are processed through WhatsApp/Meta. If a project requires a registrar, hosting provider or other platform, relevant information may be shared with that provider to deliver the requested service.
6. International processing
Some service providers may store or process information outside South Africa. Where this occurs, we take reasonable steps to use reputable providers and ensure that the transfer is handled consistently with applicable data-protection requirements.
7. Security
We use reasonable technical and organisational safeguards to protect personal information against loss, unauthorised access, misuse or disclosure. No internet transmission or storage method is completely secure, and absolute security cannot be guaranteed.
8. Retention
We retain information only for as long as reasonably necessary for the purpose for which it was collected, to maintain client and financial records, resolve disputes and comply with legal obligations. Information that is no longer required will be securely deleted, destroyed or de-identified where reasonably practicable.
9. Your rights
Subject to applicable law, you may ask whether we hold personal information about you, request access or correction, object to certain processing, withdraw consent where consent is the basis for processing, or request deletion where we are no longer legally entitled or required to retain it.

10. Cookies and analytics
At the effective date of this policy, this website does not use optional analytics or advertising cookies. Essential technical storage may be used where necessary for security or basic website functionality. If optional analytics or advertising tools are introduced, this policy and the website’s consent controls will be updated.

Please contact us first so that we can try to resolve a privacy concern. You may also lodge a complaint with the Information Regulator of South Africa through inforegulator.org.za.
